Brähler ICS Konferenztechnik International Congress Service AG (hereinafter referred to as “Brähler“) cannot provide any guarantee concerning the correctness, completeness and up-to-dateness of the information provided due to the technical characteristics of the Internet.

Brähler reserves the right to carry out alterations, additions or deletions to the provided information without prior notification or to temporarily or permanently suspend the publication. 

As the content provider, Brähler is responsible in accordance with the general laws for its own content which it makes available for use. 

Any contributions which are identified by name reflect the opinion of the respective author and not the opinion of Brähler. 

Service descriptions of Brähler for the service portfolio of the company are not offers in a legal sense, rather merely invitations on the part of Brähler to the customer to submit a contractual offer. Brähler shall not be obliged to accept the offers of the customer.

- Linking:

External links to the contents made available by other providers must be distinguished from Brähler’s own contents. The provision of external links does not mean that the contents provided via the external link belong to Brähler. By means of the external link, Brähler is merely making third party contents available for use. The provision of external links represents active-dynamic cross references.

Brähler shall only be responsible for the said third party content if it is positively aware of legal breaches (in particular of unlawful or illegal content) and if it is technically possible and reasonable for it to prevent the use of such content.

At the time of initial provision of the external links, Brähler checked whether the third party content could lead to possible liability under civil or criminal laws. However it cannot be excluded that the content may be subsequently altered by the respective providers.

Brähler is not legally obliged to constantly check the third party content to which it refers in its service for changes which could lead to new obligations. Brähler cannot be reasonably expected to constantly monitor the external links without concrete indicators of legal breaches. Only the provider of these pages shall be responsible for contents which go beyond the above and in particular only the provider of these pages shall incur liability for losses connected to the use or non-use of information which is presented in such a way and not the party which merely provides reference to the respective publication via links.

Only when Brähler becomes aware or is informed by others that a concrete service to which it has provided a link incurs civil or criminal liability will it remove the link to the said service, provided that this is technically possible and reasonable for Brähler. 

- Guest book and forums:

The exclusion of liability for links shall apply in the same way also to third party entries in guest books, discussion forums, chat rooms and mailing lists set up by Brähler. Brähler shall only be responsible for the said third party content if it is positively aware of legal breaches (in particular of unlawful or illegal content) and if it is technically possible and reasonable for it to prevent the use of such content. Only when Brähler becomes aware or is informed by others that a concrete third party entry incurs civil or criminal liability will it carry out the (partial) deletion/blackening of the third party entry, provided that this is technically possible and reasonable for Brähler. Racist, sexual and contemptuous entries will be removed by Brähler immediately once it becomes aware of such.

- Copyright

Brähler endeavours to use graphics, sounds and texts created by itself or to refer to licence-free graphics, sounds and texts. When using external works, Brähler has checked these for existing authorships and authorships to be named, as well as licence rights to be obtained prior to their first use and posting on the Internet.

- Closing provision concerning liability and exclusion of liability

Should any individual clauses of this liability provision with exclusion of liability be or become ineffective, these shall be replaced by the statutory regulation from which they deviate.

Copyright and ancillary copyright

The contents published on this website (such as texts, pictures, graphics) and the design and layout of the website are subject to German and worldwide copyright and ancillary copyright laws. 

Any use which is not permitted by the copyright and ancillary copyright holder shall require the prior written agreement of Brähler or the respective author and/or (licence) right holder. This shall apply in particular to the duplication, editing, translation, saving, processing and reproduction of contents in databases or other electronic media or systems. The creation of copies and downloads merely for personal, private and non-commercial use is permitted.

The unauthorised duplication and distribution of individual contents or complete pages is not permitted and can give rise to prosecution. Breaches of copyright and the infringement of copyright-related rights of use will be prosecuted both under civil law­ and under criminal law.  In accordance with German civil law, omission and damages, reimbursement of expenses, handover, correction or destruction of the duplication devices and the public announcement of any judgement are possible. Legal action in accordance with legal ordinances of other countries is possible.
